1. General rule
You may use Sparkery services only for lawful, personal or properly authorised business purposes and in a way that does not harm people, Sparkery, other users, third parties, devices, systems or networks. You must also follow the Website Terms, EULA, product instructions and reasonable security notices.
2. Law, safety and harmful conduct
You must not:
Break any law, regulation, court order, sanction, export restriction or third-party right.
Harass, threaten, exploit, discriminate against, stalk, deceive or endanger another person.
Use Sparkery information to diagnose, treat or make emergency, medical, insurance, employment or other high-impact decisions about another person.
Encourage unsafe exercise, diet, medication, device use or conduct contrary to product instructions or professional advice.
Use the smart scale if you are pregnant or use a pacemaker, artificial lung, wearable electrocardiograph or another medical device, contrary to the manufacturer contraindication.
Use the smart scale on a slippery, soft or uneven surface, exceed its 180 kg capacity, use damaged or substandard batteries, or ignore its reset, positioning and measurement instructions.
Use a damaged Sparkery band, attempt to replace its non-replaceable battery, charge it under bedding or against the body, or expose it outside its stated temperature, handling or storage limits.
Impersonate Sparkery, a Partner, healthcare professional, public authority or another person.
3. Security and system integrity
You must not:
Introduce malware, ransomware, spyware, malicious code or harmful content.
Gain unauthorised access, probe vulnerabilities, bypass authentication, defeat rate limits or interfere with security controls.
Overload, disrupt, disable, damage or impair services, APIs, apps or connected products.
Use unsupported modifications, tamper with firmware or circumvent geographic, licence, purchase or feature restrictions.
Publicly disclose a vulnerability before giving Sparkery a reasonable opportunity to investigate and address it.
4. Data, privacy and account misuse
You must not:
Use another person’s account, device, identity or health information without permission.
Submit false, manipulated or misleading health, identity, payment or support information.
Collect, scrape, harvest, infer or combine personal information without authority and a lawful basis.
Share passwords, authentication codes, payment-card data or unnecessary sensitive information through support channels.
Attempt to identify an individual from anonymised, aggregated or Partner Programme data.
5. Intellectual property and technical restrictions
You must not:
Copy, modify, translate, distribute, sell, sublicense or create derivative works from protected software or content except where expressly authorised.
Reverse engineer, decompile, disassemble or discover source code or non-public interfaces except to the limited extent law permits and that permission cannot be excluded.
Remove notices, watermarks, trade marks or rights-management information.
Use Sparkery content, data or interfaces to train, test or build a competing product without written permission.
6. Automated access, scraping and APIs
You must not use bots, crawlers, scripts, automated agents or AI systems to access, scrape, copy, test or interact with Sparkery services unless an authorised interface or written permission expressly allows it. Any authorised automation must respect rate limits, security controls, data-protection obligations and documented technical requirements.
7. Marketing, referrals, promotions and competitions
You must not:
Send spam, unlawful direct marketing, fraudulent promotions or deceptive messages.
Misuse a Partner Code, create self-referrals, fabricate orders, automate competition entries or manipulate referral attribution.
Publish fake, undisclosed incentivised or misleading reviews or testimonials.
Misrepresent price, availability, urgency, health outcomes, product performance or a relationship with Sparkery.
Use Sparkery trade marks, advertising assets or claims without the permission required by the Partner Agreement or campaign rules.
8. User content and support communications
Where a feature allows content or communications, you must have the rights and permissions needed to submit it. Content must be accurate, relevant, lawful and free from malicious code. Do not send unnecessary health information or another person’s personal information.
Sparkery may remove or restrict content that infringes rights, creates risk, is abusive, misleading or unlawful, or is unrelated to the service. Sparkery does not undertake to monitor every communication.
9. Security responsibilities
You must:
Keep account credentials and connected devices secure.
Use supported software versions and install security and safety updates promptly.
Follow pairing, synchronisation, measurement, charging, cleaning, storage, water-resistance, battery, temperature, compatibility and disposal instructions for the relevant product.
Notify Sparkery promptly of suspected compromise, unsafe product behaviour or account misuse.
10. Monitoring and investigation
To protect users and systems, Sparkery may log activity, investigate suspected misuse, preserve evidence, restrict access and cooperate with authorities, subject to applicable privacy law. Sparkery may use proportionate fraud, security and abuse-detection measures but does not guarantee that all misuse will be detected.
11. Enforcement
Where reasonably necessary and proportionate, Sparkery may warn a user, request corrective action, remove or restrict content, reset credentials, limit features, suspend or terminate access, block devices or addresses, reverse improperly obtained benefits, cancel abusive orders or entries, and report unlawful conduct. Urgent action may be taken without advance notice to protect people, data, systems or product safety.
You may ask support to review an enforcement decision and provide relevant evidence. Sparkery will consider the request fairly but may keep restrictions in place while a material risk remains.
12. Reporting
Report suspected misuse, security issues or unsafe product behaviour through https://www.sparkery.com/support or support@sparkery.com. Provide enough information to investigate, but do not send passwords, authentication codes, payment-card details or unnecessary sensitive information.
13. Changes and precedence
Sparkery may update this policy to address new services, risks or legal requirements. The current version and effective date will be published. If this policy conflicts with the Website Terms or EULA, those terms prevail for the relevant contract or licence.
