1. About Sparkery and these terms
https://www.sparkery.com, the Sparkery mobile application and related services are operated by Sense Technology Group Limited, company number 15382298, VAT number GB 471 2294 96. These terms govern use of the website and digital services and the sale of products for delivery in the United Kingdom.
By using the services, creating an account or placing an order, you agree to the parts of these terms that apply. The Privacy Policy, Cookie Policy, Acceptable Use Policy, End User Licence Agreement and Health and Wellbeing Disclaimer also apply where relevant.
These terms do not exclude or reduce rights that cannot lawfully be excluded, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2. Eligibility and consumer status
Users must be at least 16 years old. A user under 18 should involve a parent or guardian when entering a purchase contract or making health-related choices. You must provide accurate information and have authority to use the payment method and any data submitted.
These terms are intended for consumers. If you purchase wholly or mainly for business purposes, consumer rights may not apply and Sparkery may require separate business terms before accepting the order.
3. Products and services
Sparkery provides the Sparkery band, a connected wearable device, and a smart body-fat scale intended primarily for home use, together with mobile-app access and web-based wellbeing content. Features may include activity, sleep, recovery, heart rate, heart-rate variability, weight, body-composition trends, goals, reports and personalised or AI-supported guidance.
Product images, measurements, feature lists and compatibility information are provided to help you choose. Minor changes that do not materially reduce the product may occur. Current specifications, warnings and operating limits are shown on the product page or in product instructions. The smart scale is specified for a weighing range of 0.1 to 180 kg and home use. The Sparkery band is specified as IP68 water-resistant, but the rating applies only under the stated test conditions and does not replace the care and use instructions.
4. Health and wellbeing notice
Important
Sparkery is a general wellbeing service. It is not a medical device, healthcare provider or emergency-monitoring service. Measurements and guidance can be incomplete, delayed or inaccurate and must not replace professional medical advice.
Read the Health and Wellbeing Disclaimer and product-specific instructions before use. Call 999 or 112 in an emergency. Consult an appropriately qualified professional before making material changes to exercise, diet, sleep, medication or treatment, particularly if you have a medical condition, are pregnant, use an implanted device or have concerns about your health.
The smart scale uses a weak electrical current to estimate body composition. The product instructions prohibit its use by pregnant users and people who use medical devices such as pacemakers, artificial lungs and wearable electrocardiographs. Do not use the smart scale if any of these circumstances apply. See section 23 for further product-specific safety rules.
5. Accounts and security
Provide accurate and current information and keep login credentials confidential.
Use reasonable security on your phone, email account and connected devices.
Notify Sparkery promptly of suspected unauthorised access, loss of a device or misuse of an account.
Do not share an account or another person’s health information without permission.
You are responsible for activity on your account unless it results from Sparkery’s failure to use reasonable care. Sparkery may require identity or security checks and may suspend access where reasonably necessary to protect users, data, payments or the services.
6. Orders and contract formation
A product listing is an invitation to place an order. Your order is an offer to buy. A contract is formed when Sparkery sends an express order acceptance or dispatch confirmation. An automated acknowledgement that an order was received is not necessarily acceptance.
Sparkery may reject or cancel an order before acceptance where a product is unavailable, payment is not authorised, a price or description contains an obvious error, quantity limits apply, delivery is unavailable or Sparkery reasonably suspects fraud or promotional abuse. If payment has been taken, it will be refunded.
7. Prices, VAT, payment and pricing transparency
Prices are shown in pounds sterling and include VAT unless clearly stated otherwise. The total payable price, including any delivery charge and optional item, is shown before the order is placed. Optional charges are not added without your express choice.
Payments may be processed by Shopify Payments, PayPal, Stripe, Klarna or another provider displayed at checkout. Provider terms and eligibility requirements may apply. Sparkery does not guarantee that every payment method will always be available.
Sparkery may change prices prospectively, but a change will not affect an accepted order except where the displayed price was an obvious error that you should reasonably have recognised. Sparkery may cancel an affected order and offer the correct price.
8. Promotions, Partner Codes, competitions and reviews
Discounts, Partner Codes, competitions and other promotions may have separate eligibility rules, opening and closing dates, product exclusions and limits. Unless stated otherwise, codes cannot be combined, have no cash value and may be withdrawn or cancelled where obtained or used improperly.
Reviews and testimonials must reflect genuine experiences. Incentivised content must be disclosed. Sparkery may moderate or remove content that is misleading, unlawful, abusive or not based on a genuine experience, without suppressing legitimate negative feedback.
9. Delivery
Orders are currently accepted for UK delivery only. The estimated delivery window is shown at checkout or in the order confirmation. Sparkery normally aims to process and dispatch orders promptly, often within 24-48 hours, but delivery estimates are not guaranteed.
For consumers, risk in goods passes when the goods are delivered to you, a person identified by you or a carrier appointed by you who was not offered by Sparkery. Title passes when Sparkery receives payment in full. Sparkery remains responsible for the carrier it selects, subject to events outside reasonable control.
If delivery is materially delayed, lost or damaged, contact support promptly. Sparkery will investigate and provide the remedy required by law, which may include replacement, re-delivery, cancellation or refund.
10. Statutory right to cancel distance purchases
For most goods bought online, a consumer may cancel without giving a reason within 14 days after the day the goods are received. If one order is delivered in separate lots, the period generally runs from receipt of the last lot. This statutory right is separate from the additional 28-day return policy below.
To cancel, send a clear statement through the support page or by email before the deadline. You may use the model cancellation form in the Appendix, but it is not compulsory. Return the goods within 14 days after telling Sparkery that you are cancelling, following the return instructions supplied by support.
Unless the goods are faulty, incorrect or Sparkery failed to give required information, you normally bear the direct return cost. Do not send goods to the registered office unless Sparkery confirms it is the correct return address.
11. Handling, packaging and deductions
During the statutory cancellation period, you may handle goods only as you reasonably could in a shop to establish their nature, characteristics and functioning. Sparkery may reduce the refund for diminished value caused by handling beyond that level. Original packaging is helpful but is not an absolute condition of statutory cancellation.
You should take reasonable care of goods, accessories, manuals and packaging and use tracked return delivery. Sparkery is not responsible for return loss caused by your chosen carrier.
12. Additional 30-day return policy
In addition to statutory rights, Sparkery offers a goodwill return period of 30 days from delivery for eligible change-of-mind returns. Under this additional policy, products must be complete, in the original packaging, unworn, unused, unactivated and in a resaleable condition, with proof of purchase.
The goodwill policy does not reduce statutory cancellation or faulty-goods rights. Sparkery may refuse a return under the goodwill policy where its conditions are not met while still providing any remedy required by law.
13. Sealed hygiene-sensitive goods and other exceptions
The statutory cancellation right may not apply to sealed goods that are genuinely not suitable for return for health-protection or hygiene reasons once unsealed. Sparkery will rely on this exception only where the product was sealed when supplied and the legal conditions are met. This may apply to a wearable or component intended for close body contact.
Other statutory exceptions may apply to personalised goods, goods that deteriorate rapidly and fully performed services. These exceptions do not remove rights in faulty, misdescribed or unsafe goods.
14. Digital content, app access and early performance
Where digital content is supplied immediately, Sparkery may ask you to expressly consent to supply beginning during the cancellation period and acknowledge that the statutory right to cancel that digital content may be lost once supply begins. If required consent or acknowledgement is not obtained, your statutory rights remain unaffected.
Where a paid service begins during a cancellation period at your express request, Sparkery may deduct a proportionate amount for the service supplied before cancellation where the law permits.
15. Refunds
For a valid statutory cancellation, Sparkery will refund the price and the cost of the least expensive standard outbound delivery offered, normally within 14 days after receiving the returned goods or evidence that they were sent, whichever is earlier. Sparkery may withhold the refund until then. Refunds are made to the original payment method unless otherwise agreed.
For a faulty, incorrect, lost or damaged product, Sparkery will also reimburse reasonable return costs where required. Bank or payment-provider processing times are outside Sparkery’s control.
16. Faulty goods and statutory remedies
Goods must be of satisfactory quality, fit for purpose and as described. Digital content must be of satisfactory quality, fit for purpose and as described. Services must be performed with reasonable care and skill.
Depending on the circumstances and applicable law, remedies may include the short-term right to reject goods, repair, replacement, price reduction, repeat performance or final rejection. Nothing in these terms replaces or limits those statutory remedies.
17. Commercial warranty
Sparkery provides a 12-month commercial warranty against defects in materials or workmanship under normal intended use. The warranty starts on delivery and is additional to statutory rights. It does not cover accidental damage, misuse, unauthorised modification or repair, normal wear, cosmetic damage that does not affect function, consumable parts or failure to follow instructions.
To make a warranty claim, contact support with proof of purchase, the product identifier and a clear description of the issue. Sparkery may request reasonable diagnostic steps and return of the product. Repair, replacement or another warranty remedy will be selected reasonably, without limiting statutory rights.
18. Lifetime mobile-app access
Meaning of lifetime access
Where a product listing includes lifetime mobile-app access, this means access without a recurring app fee for as long as Sparkery continues to make the relevant app service generally available for that product. It does not mean the lifetime of a user, device or company.
Lifetime access is personal, non-transferable and linked to the supported account and product. It remains subject to these terms, the EULA, reasonable security updates and compatible hardware and operating systems. Sparkery will not withdraw paid lifetime access arbitrarily. If the relevant service is permanently discontinued without a reasonable replacement, Sparkery will provide any notice and remedy required by consumer law.
Sparkery does not currently charge a recurring subscription fee or offer a free trial. Any future optional subscription will require separate clear pre-contract information and express acceptance before recurring payment is taken.
19. Acceptable use and intellectual property
You must use the website, app, connected products and services lawfully and in accordance with the Acceptable Use Policy. Sparkery and its licensors retain all intellectual-property rights in the brand, website, app, software, designs, content, databases and documentation.
Subject to the EULA, Sparkery grants a limited, personal, non-exclusive, non-transferable and revocable right to use the services for their intended personal purpose. You must not copy, scrape, reverse engineer, distribute or commercially exploit protected content except where law expressly permits and that permission cannot be excluded.
20. Third-party services and health integrations
The services may integrate with Apple Health, Google Health Connect or other third-party platforms. Those services are controlled by third parties and have their own terms, permissions and privacy practices. Data may be delayed, transformed, duplicated or unavailable. Sparkery is not responsible for third-party services outside its control, without excluding liability that law places on Sparkery.
21. AI-supported features
AI-supported content may be generated from patterns in user-provided and device data. It may not reflect every relevant circumstance and may contain errors. It is general wellbeing information only and must not be used for medical, emergency, insurance, employment, legal, financial or other high-impact decisions.
22. Availability, updates and connected-product security
Sparkery may maintain, update, replace or discontinue features to improve security, compatibility, legal compliance or functionality. You may need to install app, firmware or operating-system updates to continue using some features. Sparkery does not promise uninterrupted operation, but will provide remedies required for paid digital content or services.
You must use supported versions, protect credentials and follow security instructions. Sparkery may issue product-security notices, vulnerability-reporting information and minimum update-period information where required under applicable connected-product security law.
23. Product safety and recalls
Read and retain all product instructions, contraindications, warnings, charging, cleaning, storage, measurement, compatibility and disposal information. Product-specific instructions take priority for the safe operation of the relevant product. Stop using a product and contact Sparkery if it appears damaged, unsafe, overheats, causes irritation or behaves unexpectedly. Sparkery may issue a safety notice, software update, repair, replacement, refund or recall where reasonably necessary or legally required.
23.1 Smart scale safety and measurement limitations
The smart scale passes a weak electrical current through the body to estimate body composition. It must not be used by pregnant users or by anyone who uses a pacemaker, artificial lung, wearable electrocardiograph or another medical device that may be affected. This prohibition applies even if the user intends to rely only on selected readings.
Use the scale on a hard, flat and non-slip floor, not on carpet or another soft surface. Do not exceed the stated 180 kg capacity. Reset the scale to 0.0 kg before measurement and follow the positioning instructions, including barefoot contact, feet apart and a stable upright posture.
For consistency, measure at a similar time and under similar conditions. Measurements may be less reliable directly after strenuous exercise, eating or drinking, bathing or sauna use, substantial water or alcohol intake, or during illness. Body-composition values for users under 18, people receiving artificial dialysis, people experiencing swelling and people over 80 are reference-only.
23.2 Sparkery band safety, temperature and charging
Handle the Sparkery band carefully. Do not use it if it is damaged, burned, punctured or crushed. Avoid excessive dust or sand and do not allow children to play with it without supervision. The stated operating range is 0°C to 45°C and the stated storage range is -20°C to 70°C. Avoid dramatic changes in temperature or humidity.
The band contains a 95 mAh rechargeable lithium-polymer battery that is not user-replaceable. Do not attempt to replace or service it yourself. Use the supplied or approved charging equipment. While charging or connected to power, do not sleep on the device or charger or place it under a blanket, pillow or your body. Take particular care if you have reduced sensitivity to heat.
23.3 Cleaning, batteries and disposal
Clean the smart scale with a soft cloth dampened with water and dry it before use. Its stated working-temperature range is -10°C to 60°C. Keep it away from direct sunlight, excessive heat and humid environments. Insert replacement batteries in the correct orientation, do not use damaged or substandard batteries, and remove them if the scale will be unused for a significant period.
Do not incinerate the Sparkery band or its battery and do not dispose of the band, scale or batteries with ordinary household waste. Follow the product instructions and local electrical and battery recycling arrangements.
24. Suspension and termination of access
Sparkery may proportionately restrict or suspend an account or digital feature where reasonably necessary for security, fraud prevention, legal compliance, service integrity or a material breach. Where practicable, Sparkery will explain the reason and provide an opportunity to correct the issue. You may stop using the services and delete the app at any time.
25. Liability
Nothing excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where liability cannot be excluded, or breach of mandatory consumer rights.
Sparkery is responsible for foreseeable loss caused by its breach or failure to use reasonable care. Sparkery is not responsible for business losses where you contract as a consumer, or for loss caused by unsupported devices, failure to install required updates, unauthorised modification, misuse, inaccurate information supplied by you or third-party services outside Sparkery’s reasonable control, except where law provides otherwise.
26. Complaints
Contact https://www.sparkery.com/support or support@sparkery.com with the order number and a clear description of the issue. Sparkery aims to acknowledge complaints promptly and resolve them fairly. Nothing prevents you from seeking advice from Citizens Advice or exercising court or statutory rights.
Sparkery does not commit to a particular alternative-dispute-resolution provider unless one is identified in writing for the dispute. Any ADR process used will be described separately.
27. Changes to these terms
Sparkery may update these terms to reflect legal, safety, security, technical or business changes. The current version and effective date will be published. Changes do not retroactively alter an accepted product order. Material changes affecting an ongoing paid digital service will be notified where reasonably practicable and any remedy required by law will be provided.
28. Governing law and courts
These terms are governed by the laws of England and Wales. If you are a consumer, you also retain mandatory protections and access to the courts available in the part of the United Kingdom where you live.
