1. Licensor and acceptance
Sense Technology Group Limited, trading as Sparkery, licenses the Sparkery mobile application (App) to you. By clicking I Agree, downloading, installing, accessing or using the App, you accept this EULA. If you do not accept it, do not install or use the App.
2. Eligibility and consumer status
You must be at least 16 years old. If you are under 18, involve a parent or guardian where appropriate. The licence is for individual, personal and non-commercial use in the United Kingdom. Mandatory consumer rights are not excluded.
3. App stores and related terms
The App may be supplied through Apple App Store, Google Play or another authorised marketplace. Marketplace terms, device terms and carrier terms also apply. If a mandatory marketplace term conflicts with this EULA, the mandatory term prevails to the extent required.
4. Licence grant
Subject to this EULA, Sparkery grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the current supported version of the App on compatible devices you own or control, solely for the App’s intended purpose.
No ownership is transferred. Rights not expressly granted are reserved by Sparkery and its licensors.
5. Lifetime app access
Meaning of lifetime access:
Where your qualifying Sparkery product includes lifetime app access, you do not pay a recurring App fee for as long as Sparkery continues to make the relevant App service generally available for that product. This is not the lifetime of a user, phone, device or company.
Access is personal, non-transferable and linked to the supported account and product. It remains subject to security updates, compatibility, this EULA and lawful suspension rights. Sparkery will not withdraw paid lifetime access arbitrarily. If the relevant service is permanently discontinued without a reasonable replacement, Sparkery will provide any notice and remedy required by consumer law.
6. Accounts, devices and connectivity
Some functions require a Sparkery account, compatible hardware, Bluetooth, internet access, notifications, background refresh, device permissions or a supported operating system. You are responsible for device, network and carrier charges and for keeping credentials and devices secure. The Sparkery band is specified as having up to 30 days of device memory, so you should synchronise it as directed and must not rely on the band as indefinite storage or backup.
Functionality may vary by device, operating system, permissions, location, connectivity and hardware condition. Do not use unsupported, rooted, jailbroken or materially modified devices where they create a security or compatibility risk.
7. Health-platform integrations and permissions
If you connect Apple Health, Google Health Connect or another platform, you authorise the App to exchange the data categories and for the purposes shown in the permission screen. You can withdraw permissions through the App, platform or device settings. Withdrawal may disable the related feature.
Third-party platform terms and privacy notices apply. Sparkery does not control third-party availability, data transformations or compatibility.
8. Data and privacy
The App processes account, device, technical, health and wellbeing information as described in the Privacy Policy. Review permission prompts carefully and provide only information you are authorised to provide. Health information is processed under the lawful basis and special-category condition stated in the Privacy Policy and relevant consent screen.
9. Restrictions
You must not:
Copy, modify, translate, adapt, distribute, sell, rent, lease, sublicense or commercially exploit the App.
Reverse engineer, decompile, disassemble or attempt to discover source code, algorithms or non-public interfaces, except where law expressly permits and that permission cannot be excluded.
Remove proprietary notices or bypass security, access, geographic, licence or technical restrictions.
Use the App to build or train a competing product, scrape data, conduct unauthorised testing or overload systems.
Use another person’s account, device or health information without permission.
Use the App unlawfully, for a prohibited high-impact decision or contrary to the Acceptable Use Policy.
10. Health, wellbeing and AI-supported features
The App provides general wellbeing information and may use AI-supported personalisation. It is not a medical device, medical service or emergency-monitoring system. It does not diagnose, treat, cure, monitor or prevent disease. Measurements and outputs may be inaccurate, incomplete or delayed and depend on correct device placement, use, pairing and synchronisation.
Do not use the App as a substitute for professional advice or to make medical, emergency, insurance, employment or other high-impact decisions. App screens and outputs do not override the product instructions, contraindications or safety warnings. Read the Health and Wellbeing Disclaimer and all product instructions.
10.1 Smart scale restrictions
The smart scale uses a weak electrical current to estimate body composition. The product instructions prohibit use by pregnant users and people who use pacemakers, artificial lungs, wearable electrocardiographs or other medical devices that may be affected. The App must not be used to bypass or disregard that prohibition.
Scale measurements are reference-only and depend on correct setup and use. Follow the hard, flat and non-slip floor requirement, the 180 kg maximum capacity, barefoot positioning and the measurement conditions stated in the instructions.
10.2 Sparkery band restrictions
The band is specified as IP68 water-resistant, but the rating does not authorise unrestricted water exposure. Follow the product instructions, stated operating and storage temperature ranges, charging guidance and battery warnings. Do not use a damaged band or attempt to replace its non-replaceable battery.
11. Intellectual property and open-source components
Sparkery and its licensors retain all rights in the App, software, interfaces, databases, content, trade marks, designs and documentation. Open-source components, if any, remain subject to their applicable licences and notices, which may grant rights directly to you for those components.
12. Updates, security and end of life
Sparkery may provide automatic or manual updates for security, legal compliance, compatibility, safety or feature development. You may need to install updates to continue using the App or connected products. Sparkery may withdraw support for obsolete operating systems or devices after reasonable notice where practicable.
Sparkery may change, suspend or discontinue a feature. Where a change materially affects paid digital content or lifetime access, Sparkery will provide the notice and remedy required by consumer law. Security, safety and fraud-prevention changes may take effect immediately.
13. Support and vulnerability reporting
Support requests and vulnerability reports may be submitted through https://www.sparkery.com/support or support@sparkery.com. Do not publicly disclose a vulnerability before giving Sparkery a reasonable opportunity to investigate. Sparkery does not promise uninterrupted support or availability, but this does not affect statutory rights.
14. Third-party services and content
The App may rely on app stores, cloud hosting, mapping, notifications, analytics, health platforms and other third-party services. Their terms and privacy notices apply where they act independently. Sparkery is not responsible for third-party services outside its reasonable control, except to the extent law places responsibility on Sparkery.
15. Warranties and consumer rights
The App is provided with the quality, fitness, description and remedy rights required by applicable consumer law. Subject to those rights, Sparkery does not promise that the App will be uninterrupted, error-free, compatible with every device or suitable for a particular personal goal.
If an app store refunds a purchase or provides a mandatory remedy, that process may apply in addition to rights against Sparkery. Nothing in this EULA excludes statutory rights applying to digital content or services.
16. Liability
Nothing excludes liability where exclusion is unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of mandatory consumer rights.
Sparkery is responsible for foreseeable loss caused by its breach or failure to use reasonable care. Sparkery is not responsible for business loss where you use the App as a consumer, or for loss caused by unsupported devices, failure to install updates, unauthorised modification, misuse, failure to follow product instructions or contraindications, inaccurate information supplied by you, connectivity failure or third-party services outside Sparkery’s reasonable control, except where law provides otherwise.
17. Suspension and termination
You may terminate this EULA by deleting the App and stopping use. Sparkery may proportionately suspend or terminate the licence for material breach, unlawful use, security or safety risk, fraud, withdrawal of the App or failure to install a critical update. Where practicable, Sparkery will give notice and an opportunity to remedy a remediable breach.
On termination, you must stop use and delete copies. Provisions intended to continue, including intellectual property, confidentiality, liability, restrictions and governing law, survive. Termination does not remove accrued consumer remedies.
18. Export and legal compliance
You must not use, export or make the App available in breach of sanctions, export-control or other applicable law. You confirm that you are not prohibited from receiving the App under applicable restrictions.
19. App-store-specific acknowledgements
19.1 Apple App Store
If you obtain the App through Apple App Store, you and Sparkery acknowledge that this EULA is between you and Sparkery, not Apple. Sparkery, not Apple, is responsible for the App, maintenance, support, warranties, product claims and investigation or defence of intellectual-property claims, except where mandatory law or Apple’s terms provide otherwise. Apple and its subsidiaries are third-party beneficiaries of this clause and may enforce it.
19.2 Google Play and other marketplaces
If you obtain the App through Google Play or another marketplace, Sparkery remains responsible for the App except to the extent the marketplace’s mandatory terms allocate a responsibility differently. The marketplace may enforce terms that expressly benefit it.
20. Changes to this EULA
Sparkery may update this EULA for legal, security, safety, compatibility or service changes. The current version and effective date will be made available in the App or website. Material changes will be notified where reasonably practicable. Continuing to use the App after a notified effective date constitutes acceptance only to the extent permitted by law; Sparkery will obtain fresh acceptance where required.
21. Governing law and courts
This EULA is governed by the laws of England and Wales. If you are a consumer, you retain mandatory rights and access to the courts available in the part of the United Kingdom where you live.
