Sparkery is a general wellbeing service. It is not a medical device, healthcare provider or emergency-monitoring service. This disclaimer does not replace product-specific instructions, safety warnings or contraindications.
1. Scope
This disclaimer applies to Sparkery wearables, smart scales, the website, mobile application, Health Hub, personalised coach, AI-supported guidance, reports, scores, trends, goals, recommendations, notifications and related content.
2. General wellbeing only
Sparkery products and services support general wellbeing, self-awareness and lifestyle tracking. They are not intended to diagnose, treat, cure, monitor or prevent a disease, injury, disability or medical condition and are not a substitute for a doctor, pharmacist, dietitian, physiotherapist, mental-health professional or other qualified professional.
Marketing descriptions such as connected health, health insights or personalised guidance describe general wellbeing functions and do not mean that Sparkery provides regulated healthcare or clinical assessment.
3. No emergency monitoring
Sparkery does not detect or respond to emergencies and should not be relied on to alert emergency services, carers or healthcare providers. If you think you may be experiencing a medical emergency, call 999 or 112 immediately or seek other appropriate emergency help.
4. Measurements, estimates and trends
Wearable and scale outputs, including heart rate, heart-rate variability, sleep, recovery, activity, weight, body-fat and other body-composition estimates, may be affected by fit, placement, movement, hydration, food and drink, recent exercise, bathing or sauna use, illness, skin or foot contact, floor surface, environment, device condition, charging, connectivity, user inputs, algorithms and third-party data.
Results are estimates and trends, not clinical measurements. A single reading may be misleading. Do not ignore symptoms or professional advice because a reading appears normal, and do not assume that a medical condition exists because a reading appears unusual.
Results from different products, software versions or measurement methods may not be directly comparable. For trend tracking, use the same device at a similar time and under similar conditions and follow the product instructions.
5. Smart-scale and body-composition features
Body-composition values are estimates produced using a weak electrical current and can vary with hydration, food or drink, exercise, bathing or sauna use, alcohol intake, illness, time of day, foot contact, posture and other factors. They must not be used for diagnosis, medication decisions or assessment of another person’s health.
The smart scale product instructions prohibit use by pregnant users and by people who use medical devices such as pacemakers, artificial lungs and wearable electrocardiographs. The weak current used for body-composition measurement may interfere with medical devices and lead to serious consequences. If any of these circumstances apply, do not use the smart scale.
Use the scale only on a hard, flat and non-slip floor. Do not use it on carpet, another soft surface or a slippery floor, and do not exceed the stated 180 kg capacity. Reset it to 0.0 kg before each measurement. Measure barefoot, with feet apart and your body stable and upright.
For more consistent measurements, use the scale at a similar time and under similar conditions. Avoid measuring directly after strenuous exercise, eating or drinking, a bath or sauna, substantial water or alcohol intake, or during illness.
Measurements for users under 18, people receiving artificial dialysis, people experiencing swelling and people over 80 are reference-only. They may be less reliable and must not be used for clinical assessment.
6. Wearable safety and skin contact
Use the Sparkery band only as instructed. It is specified as IP68 water-resistant, but this rating does not mean that every form or duration of water exposure is safe. Keep it clean and dry as directed, avoid excessive tightness, dust and sand, and inspect the band and magnetic USB charger. Stop use if you experience pain, numbness, irritation, swelling, allergic reaction, overheating, leakage, damage or another concern. Do not use a band that has been dropped, burned, punctured or crushed.
The stated operating-temperature range is 0°C to 45°C and the stated storage range is −20°C to 70°C. Avoid extreme temperatures, direct sunlight, dramatic temperature changes and excessive humidity. Children must not be allowed to play with the band without supervision.
The band contains a 95 mAh rechargeable lithium-polymer battery that is not user-replaceable. Do not attempt to replace or service it yourself. Battery servicing must be carried out by the manufacturer or an authorised service provider.
While the band is charging or the charger is connected to power, do not sleep on it or place it under a blanket, pillow or your body. Take particular care if you have a condition that reduces your ability to feel heat against the body.
7. AI-supported guidance and personalised coach
AI-supported coaching and personalised suggestions are generated from available data and general patterns. They may omit relevant facts, contain errors, be unsuitable for your circumstances or change over time. They do not involve a clinical assessment and are not medical, nutritional, psychological, therapeutic or emergency advice.
Do not follow a recommendation that conflicts with symptoms, professional advice, medication instructions, product warnings or your own reasonable safety judgment.
8. Professional advice and medical conditions
Consult an appropriately qualified professional before making a material change to exercise, diet, sleep, medication or treatment, especially if you have a diagnosed or suspected condition, are pregnant, are recovering from injury or surgery, have a history of disordered eating, take medication, use an implanted device or experience pain, dizziness, fainting, shortness of breath or other concerning symptoms.
Never stop, start or change medication or treatment because of a Sparkery measurement or recommendation without advice from the relevant healthcare professional.
9. Exercise, nutrition and weight goals
Exercise, nutrition, sleep and weight content is general education. Individual needs vary. Stop activity and seek advice if you experience concerning symptoms. Weight and body-composition goals should be realistic and should not encourage unsafe restriction, over-exercise or disordered behaviour.
10. Age and vulnerable users
Sparkery is intended for users aged 16 or over. Smart-scale body-composition measurements for anyone under 18 are reference-only. Users under 18 should involve a parent, guardian or appropriate professional when making health-related choices. Children must not play with the band or charging equipment without supervision.
11. Third-party health platforms and data
Data imported from or exported to Apple Health, Google Health Connect or another platform may be delayed, incomplete, duplicated, rounded, transformed or unavailable. Sparkery does not control third-party platforms and cannot guarantee their accuracy, availability or continued compatibility.
12. Product instructions, warnings and recalls
Read and retain all product instructions, contraindications, warnings, charging guidance, cleaning requirements, measurement instructions, fit guidance, age restrictions, temperature limits, compatibility information and disposal guidance. Product-specific instructions prevail over this general disclaimer for safe operation.
Clean the smart scale with a soft cloth dampened with water and dry it before use. Its stated working-temperature range is −10°C to 60°C. Keep it away from direct sunlight, excessive heat and humid environments. Use correctly oriented, suitable and undamaged batteries, replace them when the low-battery indicator appears, and remove them during significant periods of non-use to reduce corrosion risk.
Do not incinerate the Sparkery band or its battery. Do not dispose of the band, smart scale or batteries with ordinary household waste. Use appropriate electrical-product and battery recycling or disposal arrangements.
Stop using a product and contact Sparkery if it appears unsafe, damaged or subject to a safety notice. Follow any recall, update, repair, replacement or disposal instruction promptly.
13. Your responsibility
You are responsible for providing accurate inputs, using products within their intended purpose and deciding whether and how to act on Sparkery information. Do not use Sparkery outputs to make medical, emergency, insurance, employment, legal, financial or other high-impact decisions about yourself or another person.
14. No guaranteed outcomes
Sparkery does not guarantee a particular health, fitness, sleep, recovery, weight, body-composition or lifestyle outcome. Results depend on many factors outside Sparkery’s control, including individual circumstances, consistency, health, device use and data quality.
15. Consumer rights and liability
Nothing in this disclaimer excludes statutory consumer rights or liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or a defective product where applicable law imposes liability.
Subject to those rights, Sparkery does not promise that wellbeing outputs are clinically accurate, complete, continuously available or suitable for a particular medical or personal objective.
